These Terms of Service (“Terms”) govern your access to and use of GhostView (“Service”), operated by Nicolas Obermeier (“we”, “us”, “our”).

By accessing or using the Service, you agree to be bound by these Terms.

2. Description of the Service

GhostView is a web-based software platform providing analytics, insights, and AI-powered features based on data retrieved via the official Meta APIs for connected Instagram accounts.

The Service includes:
• Account and media analytics
• AI-generated insights based on user-provided and platform data
• Credit-based AI usage depending on subscription tier

3. Accounts & Registration

To use GhostView, you must create an account using a valid email address and password.

You are responsible for:
• Maintaining the confidentiality of your account
• All activities conducted under your account

4. Subscriptions, Trials & Payments
   • GhostView is a paid subscription service
   • A 14-day free trial is offered
   • After the trial, access requires an active subscription (monthly or yearly)
   • Additional fees may apply for extra connected accounts or team members

Payments are processed via Stripe. Prices and features may change with prior notice.

5. AI Features & Credits

AI functionality is provided on a credit-based system, depending on the user’s subscription.

Credits have no cash value and are non-transferable.

6. Acceptable Use

You agree not to:
• Misuse or abuse the Service
• Attempt to reverse-engineer or manipulate the platform
• Use the Service for unlawful purposes

We reserve the right to suspend or terminate accounts at our sole discretion.

7. No Guarantee / Disclaimer

GhostView provides analytics and informational insights only.

We do not guarantee:
• Business success
• Growth results
• Accuracy of third-party data

The Service does not constitute business, financial, or legal advice.

8. Limitation of Liability

To the maximum extent permitted by law, GhostView shall not be liable for:
• Indirect or consequential damages
• Loss of profits, data, or business opportunities

9. Subscription, Cancellation & Refunds

Users may cancel their subscription at any time via their account settings.

Cancellations take effect at the end of the current billing period. No refunds are provided for partially used subscription periods.

Fees for additional services, add-ons, extra accounts, team members, or AI credits are non-refundable once activated or used.

Due to the digital nature of the Service and the availability of a free trial, refunds are generally excluded unless required by applicable law.

10. Termination

We may suspend or terminate access to the Service at any time for violations of these Terms.

Users may cancel subscriptions at any time via their account.

11. Governing Law & Jurisdiction

These Terms are governed by the laws of the Federal Republic of Germany.

The place of jurisdiction shall be Germany.
